Additional terms will be referred to where appropriate. The operator of this online service reserves the right to modify these terms at any time. By using the service, the user agrees to the latest version of these terms.

1. Content of the site

The Society of Music Merchants (SOMM) e. V. (‘SOMM’ in the following) assumes no responsibility for the topicality, correctness, completeness or quality of the information and content provided. SOMM rules out any liability for damage, material or non-material, caused by the use or non-use of the information provided, or through the use of erroneous and incomplete information, unless the damage can be attributed to deliberate error or gross negligence on the part of SOMM. All contents are subject to confirmation and non-binding. SOMM reserves the exclusive right to change, add to or delete parts of the site or the entire site, or suspend its availability completely or for a limited period, without notice. All e-mails received by SOMM are treated as confidential, and their content - unless expressly indicated otherwise - will not be disclosed to third parties.

2. References and links

Despite careful monitoring, SOMM hereby expressly dissociates itself from the content of all linked or connected pages that have been modified since the link was established. This statement applies to all links and references within our own online offerings, as well as to third-party entries in guest books, discussion forums or mailing lists set up by SOMM. Liability for any illegal, inaccurate or incomplete content, and especially for damages arising from the use or non-use of information presented in this form, is borne solely by the operator of the site in question, not by the party merely linking to the publication in question.

3. Copyright, performance protection rights and industrial property rights

SOMM endeavours to observe the copyright of graphics, (picture) audio files, video sequences and texts; to use its own graphics, (picture) audio files, video sequences and texts; or to use unlicensed graphics, (picture) audio files, video sequences and texts in all publications. All brands mentioned on the site, and possibly protected by third parties, are subject, without restriction, to the applicable trademark laws.

SOMM is the sole owner of the copyright and performance protection rights for published objects created by SOMM itself, such as audio and video recordings, photos and covers. Reproduction or use of such graphics, audio documents, video sequences or texts in any electronic or printed publications is prohibited without SOMM’s express permission. All audio files, videos and covers presented on this site are legally protected.

4. Legal validity of this disclaimer

This disclaimer of liability is to be regarded as part of the online site linking to this page. In the event that any portions or individual provisions of this text may not, no longer or do not wholly correspond to the prevailing laws, they shall not invalidate the rest of this document, which shall remain in full force and effect.
